Discrimination against children with disabilities : a case of violation in a public school in Warri, Delta State

Joy is 13 years old and lives in Warri, Delta State, Nigeria. She has physical impairment, precisely deformity of the right hand. She has been discriminated at school, because of her disability which she had from birth. She was denied admission into public primary school at the age of six.

In 2018 Joy was twelve years old and was still in primary three at the elementary school. This was due to starting of her primary education late. No primary schools whether government or private were ready to admit her into school because of her disability. The school authorities kept saying her disability would never allow her to participate effectively in academic activities, this according to them would be a challenge for her.

Nigeria has signed and ratified the UNCRPD since 2008 and on January 23, 2019 the government domesticated it by signing the disability bill into law. It is high time school authorities know that, not admitting any child based on disability is infringing on the child’s rights. This is a violation of Article 5 of the CRPD.
